NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO PARTICIPATE IN THE HAPPY VALLEY SCAVENGER HUNT.
Please read these rules before playing in the Happy Valley Scavenger Hunt (“Scavenger Hunt”) offered by HVV MASSACHUSETTS, INC. (“we”, “our” or “HAPPY VALLEY”). By registering and participating in the Happy Valley Scavenger Hunt at Boston Calling via the Happy Valley Insider iPhone app, you will be bound by these Official Rules, and you acknowledge that you satisfy all eligibility requirements. The term “you,” as used in these Official Rules, means any person who participates in the Scavenger Hunt by registering. The Scavenger Hunt is subject to all applicable federal, state and local laws.
HOW TO ENTER. To enter, download the Happy Valley Insider iPhone App from the Apple App Store and register by entering in your full name and email address. All participants must complete the Scavenger Hunt by 7pm EST. If you use fraudulent methods or otherwise attempt to circumvent these Official Rules, your submission may be removed from eligibility at the sole discretion of Happy Valley.
ELIGIBILITY: If you are an individual legal resident of the 50 United States or the District of Columbia and are 21 or older at the time of entry. Happy Valley employees, their immediate family members (spouses, domestic partners), and affiliates, advisors or advertising/promotion are not eligible to participate in the Scavenger Hunt. By entering the Scavenger Hunt, you agree to be bound by these Official Rules.
PRIZES: 20 winners per day will be awarded prizes. Prizes are valued from $1 to $100. Winners are responsible for all federal, state and local taxes associated with acceptance and use of each prize. Prizes are not transferable. No substitution of prizes are permitted except at Happy Valley’s option, including Happy Valley’s right to substitute a prize of equal or greater value if advertised prize is unavailable. The prizes will be awarded “AS IS” and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).
DRAWING AND PRIZE REDEMPTION: 1 prize will be given to the top 20 contestants who accumulate the most amount of points when the Scavenger Hunt game ends at 7:00pm EST on Friday May 27, Saturday May 28, 2022 and Sunday May 29, 2022. Limit one prize per person per day. Awarding of prizes will be conducted by Happy Valley, whose decisions are final. If a winner cannot be contacted or does not respond by 8pm EST each day, an alternate winner with the next highest points accrued will be selected. Winners may be required to sign and return an affidavit of eligibility in order to claim a prize and/or a publicity/liability release. Prizes must be picked up by 8pm EST each day. Prizes will not be mailed.
ODDS OF WINNING. Odds of winning depend on the number of participants and total number of points accumulated by each participant.
MARKETING LIST. By entering the Scavenger Hunt, you consent to joining the Happy Valley email marketing list for promotional and other materials, unless indicated otherwise by opting out.
ADDITIONAL TERMS: Happy Valley may, to the maximum extent permitted by applicable law and in our sole discretion, change these rules or cancel the Scavenger Hunt at any time; or modify, terminate, or suspend the Scavenger Hunt should viruses, worms, bugs, unauthorized human intervention or other causes beyond our control corrupt or impair the administration, security, fairness or proper play of the Scavenger Hunt or submission of entries. We are not responsible for: (a) lost, incomplete, or unintelligible entries or for inaccurate entry information, whether caused by you or by any of the equipment or programming associated with or utilized in the Scavenger Hunt, or by any technical or human error that may occur in the processing of entries; (b) any printing or typographical errors in any materials associated with the Scavenger Hunt; (c) any error in the operation or transmission, theft, destruction, unauthorized access to, or alteration of, entries, or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, or inaccurate transmission of, or failure to receive any entry information on account of technical problems or traffic congestion on the Internet or at any website; or (d) injury or damage to your or any other computer resulting from downloading any materials in connection with the Scavenger Hunt. We may, in our sole discretion, disqualify any individual found to be: (x) tampering with the entry process or the operation of the Scavenger Hunt App or website; (y) acting in violation of these rules; or (z) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. No greater than the number of prizes stated in these Official Rules will be awarded. If any technical errors occur in the selection of a potential prize winner or if more prizes are claimed than the number of prizes being awarded as provided in these Official Rules, we may award the prize by random drawing from among all eligible claimants.
MISCELLANEOUS. The Scavenger Hunt is governed by the laws of the Commonwealth of Massachusetts, without reference to its conflicts of law rules. If you win a prize, you may not transfer, assign, or redeem the prize for cash. We may substitute a prize with a prize of equal or greater value. Each winner agrees (for himself or herself and his or her heirs) that, by accepting the prize, we, along with our affiliates and agents, will have no liability, and will be held harmless by the winner for any liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of the prize or participation in the Scavenger Hunt, even if caused or contributed to by our negligence. Any claims arising out of or relating to this Scavenger Hunt or any other Prize may be brought only in a federal or state court in Massachusetts. If any provisions of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect. Each winner agrees that, by participating in the Scavenger Hunt, we may use the winner’s name, image or likeness in any manner and in any medium for our promotional purposes without additional compensation, except where prohibited by law, including but not limited through social media.
